    做法已不符合社会需求,因此,在我国制定一部有关安乐死的法律来完善对生命权

    保护的法律体系,加大对生命保护的力度,不但具有理论上的可行性,也具有积极

    的现实意义.

    可以在我国东部一些经济,科技,文化发达的城市做一些“试点”工作之后,先为

    安乐死“打开半扇门”,在人们可以接受的程度内为安乐死部分立法,确定哪些安

    乐死可以允许,哪些应当禁止,并随着社会的发展给予其修订与改正,等待我国东

    西部经济差距缩小,再把该结果推向全国.

    首先,从主观方面来讲,安乐死对于病人自身,是一种减少生命痛苦的方式.

    人,总是趋利避害的,没有人会说“我要去寻找痛苦,我要去远离快乐”.当一个

    人处于精神和躯体的极端痛苦之下,当生命的存在已成为一场噩梦,我们难道还要

    提及道德和伦理吗?生存这个基本的“长度”都已经不能够维持,还要来谈及生命

    的宽度,还要去顾及伦理的重量吗?

    北京大学法学博士徐景和认为,《宪法》规定公民人身自由与人格尊严不受侵犯,

    是有特定含义的.公民个人有权选择生存的方式,在特定条件下也有权选择死亡的

    方式.“安乐死”是一种在特殊情况下,在不违背国家、社会和他人利益的情况下

    所采取的一种对生命的特殊处分方式,这种处分是有严格的条件与程序的.我方所

    说的安乐死,不是随意地去选择死亡,而是按徐博士的理论,依照严格条件和程序

    去实施的事情.

    1999年11月1日,贵州一位晚期肝癌患者向全社会公开吐露了自己的心声:"谁能帮

    我实现安乐死?"据不完全统计,目前在我国有数十万的绝症患者痛苦万分地躺在医

    这样的事实到底要向我们说明什么呢?人,首先是生存权利的承受者.每一个读法

    律的学生都应当知道,生存是最基本的人身权利.然而,当生存已经不再继续存在

    ,我们还要来要求尊重社会道德,还要来要求伦理纲常,这又何苦呢?病人都已经

    “痛不欲生”,我们却还要来谈其他所谓高尚的东西,这样的行为对于垂危病人来

    说,意味着什么?我们想清楚的告诉在座各位,这样意味着病人要继续痛苦,意味

    着病人要继续受折磨.这样的状况,难道说也只有身临其境的人才能体会到吗?我

    们是活生生的人啊,这样残忍的事情,情何以堪啊!

    再者,从客观方面来说,安乐死减少了社会负担,节约了社会资源的分配.

    现今中国的国情,我们清楚看到,社会虽然在进步,但是,我们与其他国家之间的

    差距却还是如此之大.

    四川成都双流县一名4岁女童患恶性肿瘤濒临死亡,贫穷的家庭无钱让孩子维持生命

    ,几近崩溃的父亲表示:“我想让我的娃儿安乐死.” 在中国实际条件下,苛求一

    个贫困家庭用光家庭的全部费用甚至倾家荡产来维持一个必死儿童不长的寿命,这

    本身就是一种掠夺.确实,没有人可以有为他人选择死亡的权力,没有人可以随便

    地让他人去面对死亡.

    四川省第二人民医院肿瘤医院的医生在接受记者采访时证实:“有些家长看见孩子

    生了绝症,就把孩子扔到路边,指望好心人救他.”在全国各大医院,每年都有为

    数不少的此类事例出现.这些被遗弃的孩子其中一部分会被社会福利机构收养,度

    过自己生命的最后一段时光;但还有相当一部分孩子被遗弃后,因为无人救治而死

    亡.一名患有先天性心脏病和白内障等多种疾病的3个月大的女婴,被父母抱进医院

    要求“安乐死”.虽然很多人都从内心同意让她“安乐死”,但医院仍拒绝了这种

    不合法的要求,而这名女婴的最后结局就是被抛弃.这样的事情在现今发展中国家

    的中国何其寥寥.与其这样子去对待无辜的孩子,还不如让孩子们的生命在正规医

    疗机构体面地终结.

    我们仍旧处于发展中国家的行列,试问在当前中国的国情下,我们还有多少资源可

    以用来做无用功?我们还有多少人力财力来做这种“不了”的情?试想一下,如果

    我们可以把这些资源用在于建设国家,调整社会资源分配的方面,甚至,如果我们

    可以把这些资源花费在医疗事业上,研究对付各种疾病的良药,这样的选择不是更

    为妥当吗?

    我们前面已经谈到,安乐死实施的对象是患上不治之症的绝症患者,实施的前提是

    病人处于极其痛苦的情况下,在病人和其亲友的要求下,经医生认可,用人道方法

    使病人在无痛苦状态中结束生命过程.这也就避免了安乐死是一种随意为他人选择

    死亡的事实的存在.没有人愿意看到自己身边的人这样痛苦地慢慢离开,即便是伦

    理道德,当面对人生苦痛这个最大的难题时,患者无能为力,我们也要眼睁睁看着

    他们受苦吗.我们感受着这种痛苦,我们体会着这个中滋味,在无法选择的情况下

    ,我们选择了安乐死.这不是对生命的藐视,也不是道德的沦丧.反而,这是一种

    在生命面临煎熬和磨难的时候,为我们身边的亲人,为我们爱着的人,选择另一条

    更容易接受的道路.

    因此,我方认为,安乐死是尊重生命的一种方式.
